Unify Square Product Privacy Policy

Unify Square, Inc., (“Unify Square”) provides a cloud-based platform (“PowerSuite”) enabling organizations to surface actionable insights and help manage collaboration and communications platforms, optimizing and transforming performance health and user effectiveness. This Product Privacy Policy (“Policy”) explains how Unify Square collects, uses, transfers, and otherwise processes end user personal information on behalf of business customers in connection with our products and services (collectively, the “Services”). “Unify Square,” “we,” and “us” refer to Unify Square, Inc. and any of our corporate affiliates.

The customer of Unify Square (“Customer”) is the data controller with respect to such personal information, and Unify Square is the processor. This Policy is not a substitute for any privacy notice that the Customer is required to provide to their employees or other end users.

Unify Square’s processing of personal information in connection with the Services is governed by this Policy and our customer agreements (“Agreements”). In the event of any conflict between this Policy and the Agreements, the Agreements will control to the extent permitted by applicable law.

Scope

This Policy covers only Customer data collected under the authorization of Customer in order to provide the Services. This Policy does not cover any other data collection or processing, including, without limitation, data collection practices of our partners or data that we collect offline or through our publicly available webpages. Data collected by partners but which is not shared with Unify Square will be governed by the privacy policies of the partners, not this Policy.

Information We Collect

In order to provide the Services, we collect information about Customer end users such as usage information of applications connected to the Services, first and last name, email address, telephone number, IP address, collaboration and usage information of applications connected to the Services. Refer to the Agreements for more detailed information on what information we collect.

How We Use Information

We use the information we collect at the instruction of the Customer and in accordance with the Agreements to provide the Services. We may also use personal information as we believe necessary or appropriate to (i) comply with applicable law; (ii) enforce the terms and conditions that govern the Services; (iii) protect our rights, privacy, safety or property, and/or that of you or others; and (iv) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

How We Share Information with Others

We may share Customer information we collect with one or more sub-processors as necessary to provide the Services. Refer to the Agreements for more information on the sub-processors. We may also share personal information with government, law enforcement officials or private parties as required by law, when we believe such disclosure is necessary or appropriate to (i) comply with applicable law; (ii) enforce the terms and conditions that govern the Services; (iii) protect our rights, privacy, safety or property, and/or that of you or others; and (iv) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

We may sell, transfer or otherwise share some or all of Unify Square’s business or assets, including personal information, in connection with a prospective or actual sale, merger, transfer or other reorganization of all or parts of our business.

Information Security

Unify Square uses appropriate, commercially reasonable physical, electronic, and procedural safeguards to protect personal data from loss, theft, unauthorized access, disclosure, alteration, and destruction in accordance with applicable law. See the Agreements for additional information regarding Unify Square’s information security practices.

Data Subject Rights

The Customer is the data controller of their end users’ personal information. As the data controller, the Customer is responsible for receiving and responding to end users’ requests to exercise any rights afforded to them under applicable data protection law. Unify Square will assist the Customer in responding to such requests as set forth in the Agreements.

International Data Transfers

Unify Square may transfer Customer data, including personal information, outside of the country in which end users are located, including to the United States. Unify Square utilizes valid legal mechanisms such as Standard Contractual Clauses to transfer data. Additionally, Unify Square participates in the EU-US and Swiss-US Privacy Shield frameworks. See the Agreements for additional information regarding how Unify Square safeguards the personal information it transfers across borders.

Data Retention

Unify Square retains personal information for as long as necessary to (i) provide the Services; (ii) comply with legal obligations; (iii) resolve disputes; and (iv) enforce the terms of the Agreements. See the Agreements for additional information regarding Unify Square’s data retention practices.

Third Party Products

and Services The Services may integrate with or enable access to third party products. Customers that register, install or access any third party products may be required to accept privacy notices provided by those third parties. Please review those notices carefully, as Unify Square does not control and cannot be responsible for these providers’ privacy or information security practices.
